Employers that complete the True-Up after 11-30-2016 will need to file an appeal using the guidelines listed below. The appeal should be emailed to the BWC Employer Programs Unit with a subject line of Payroll True-Up appeal. Employer Programs staff will review the request and make a decision on the appeal and record the decision in the Complaint Tracker.
The Payroll True-Up policy outlines the criteria for resolution of complaints. Employer Programs will review the request to determine:
- The program removal was appropriate. If the policy was removed in error, the policy will be reinstated into all applicable programs. Notice will be sent to all interested parties.
- The U59 GOTF form should not be used for True-Up forgiveness. This form is exclusive for the forgiveness of lapse and penalty abatement.
- In order to qualify for relief the True-Up must have been filed and paid within 59 days of the established grace period.
- If good cause is not demonstrated in the appeal, GOTF may be granted if all criteria are met and it is available for the policy. Again, notice of the decision will be sent to all interested parties.
